Arguably Zambian best lawyer Keith Mweemba has objected the video evidence produced on
a DVD by Muvi Television in New Labour Party(NLP) leader Fresher Siwale Defamation of the President case, heard by Magistrate Alice Walusiku.
This is a ‘Mother Case in which Mr. Siwale allegedly called President Edgar Chagwa Lungu an identity fraud, in account that the plaintiffs real name is Jonathan Mutawale.
Meanwhile, there was jubilation within the electronically wired Court Room Court when Magistrate Alice Walisuku varied her own earlier granted bail condition of Siwale, who by 17:00 was driven to Kamwala Remand Prison to spend a 30th day and night in incarceration.
Mweemba expressed concern that Siwale was still in detention as he could not secure bail signed by a senior Government official, as the political nature of the case made senior managers and directors grow ‘Cold Feet).
“The bail conditions given by the courts were inconceivable, as Senior Government officials grew cold feet thus not willing to sign bail for a person who is accused of Defaming the President,” protested Mweemba.
Magistrate Walisuku took into consideration Mweemba’s appeal and granted Siwale K25, 000 bail in his in recognisance, with two working sureties for recognised institutions.
The NLP leader has since met the bail conditions but will spend the Wednesday 23rd May 2018 night at Kamwala Remand Prison as the Magistrate Walusiku had knocked off when the sureties were frantically finalising documentation.
Earlier, the prosecution played the April, 2 2018 Assignment Programme which featured Siwale. After watching the video, Mweemba argued that the video of the Assignment programme was tampered with by Muvi staff that edited it to suit the prosecution team , adding that the courts does not entertain secondary evidence.
The case has since been adjourned to 5th June.
