Livingstone Magistrate acquits 4 clearing agents

LIVINGSTONE Magistrate Mbololwa Mukela has acquitted four clearing agents who allegedly made false documents purporting to export used cans when in fact exported rosewood to Botswana.
This is in a case in which Phenias Kalenga, 29, director, Henry Mwamba, 42, Emmanuel Njanji, 25 and Japhet Tembo, 29 all clearing agents are charged with five counts of making a false document.
In her judgement, Magistrate Mukela said the prosecution had failed to prove that four accused persons made the false documents.
“I hereby acquit the accused persons, as there is no evidence to show that the documents were made by the four accused persons and there is no evidence that the documents were created by the four,” she said.
Magistrate Mukela said the documents that the agents had was from the exporter, Fengyu Ou, 30, a Chinese businessman.
Magistrate Mukela said despite Zambia Revenue Authority (ZRA) officers observing that there was an anomaly, they continued to produce the release order for the goods.
